This document containing the terms and conditions of use of the website www.dentestet.ro (hereinafter referred to as the “Terms and Conditions”) establishes the conditions under which any person may visit or access the website www.Axadent.ro or use in any way the services offered through the Website.

For the purposes of these Terms and Conditions: “Website” refers to the website www.Axadent.ro; “Website Administrator” refers to MEDIDENTSPOT SRL, headquartered in Cluj-Napoca, str. G. Pop de Basesti, nr. 13 A; “Service” refers to any service offered on the Website and/or any module or component thereof; “User” refers to any person who visits or accesses the Website, creates an account on the Website, or wishes to use or actually uses the Service in any way.

Failure to accept these Terms and Conditions or any provision herein, as set forth in this document, obliges the User to immediately cease accessing the Website; continued access or visitation of the Website, any page thereof, and/or use of the Service, as well as any component thereof, constitutes full and unconditional acceptance of the Terms and Conditions and every provision contained therein.

By registering, the User fully and unconditionally accepts these Terms and Conditions and agrees to use the Service strictly in accordance with them. Users understand and accept that using, accessing, or continuing to visit the Website, any page thereof, and/or using the Service or any component thereof constitutes full and unconditional acceptance of the Terms and Conditions and every provision therein; refusal to accept the Terms and Conditions obliges such Users to immediately cease accessing the Website.

Rights Over Website Content

The content and graphic elements of the Website, including but not limited to all text content and any other material transmitted in any form by and to Users (through direct viewing on the Website, newsletters, or any other materials directly or indirectly related to the Website) belong to the Website Administrator and its partners and constitute the Website Content. By way of exception, materials for which another rights holder, owner, or source is indicated on the Website, as well as opinions and/or comments expressed by Website Users posted on the Website or regarding the Website Content in general, do not belong to the Website Administrator or its partners.

Where Website Content, regardless of its location or type, is taken over by the Website Administrator from other content producers/publishers in text, image, graphic, or video format, such use is carried out in compliance with legal provisions and applicable regulations.

Users understand and accept that all information, data, and materials posted on the Website are for informational and guidance purposes only, and that the Website Administrator cannot be held liable in any way for the accuracy or validity of the Website Content or for any legal effects arising from its use.

The response received following the completion of the mini-consultation form does not constitute a real medical consultation, and the Website Administrator cannot be held responsible for this informal response, which is intended solely for informational purposes and does not constitute proper medical treatment.

Users undertake to respect all copyrights, related rights, and any other intellectual property rights held by the Website Administrator and its partners over/in connection with the Website, its Content, the Service, or any module or component thereof. Users understand and accept that any violation of these provisions may result in liability toward the authors/owners of the Website Content.

The Website Content, regardless of where it is located on the Website or its type, may be used exclusively for personal purposes, defined herein as purely non-commercial purposes, without any direct or indirect intention of obtaining profit or any kind of gain from such use. Any use of the content by third parties for purposes other than personal ones may only be made with the prior written consent of the Website Administrator.

Users who submit information or materials to the Website agree to transfer exclusively, indefinitely, and worldwide, upon submission, all rights to use, adapt, modify, and/or retransmit the content contributed or posted on the Website. The Website Administrator cannot be held responsible for any damage caused by content posted or uploaded to the Website or any of its modules (including but not limited to order or mini-consultation forms) by any person.

Any persons who send information, comments, opinions, or materials to the Website undertake not to prejudice other Users in any way through the information, comments, or materials submitted and understand that they alone may be held responsible for the accuracy, validity, and correctness of such content, including any legal consequences arising from their use.

Posting on the Website any content including materials, comments, images, video sequences, or other materials containing obscene or vulgar language, illegal, threatening, abusive, indecent, racist, chauvinistic, discriminatory messages, or content violating any rights and freedoms under applicable law is strictly prohibited.

Users understand and accept that in the event of violating any provisions of the Terms and Conditions, the Website Administrator may, at its sole discretion, refuse publication of any content submitted by a User or modify such content without prior notice or formalities.

Users understand and accept that the Website may contain links or references to other websites, including personal websites (blogs), supplier websites, advertising microsites, and others, which are considered useful in relation to the Website Content but are not under the control or guidance of the Website Administrator.

The Website Administrator is exempt from any liability for any interruption, malfunction, difficulty, or error in the operation of the Website, except where such issues are directly and exclusively caused by gross negligence on the part of the Website Administrator.

Users understand and accept that the Website Administrator is exempt from liability for any direct or indirect damages, including but not limited to loss of profit, goodwill, or other intangible losses resulting from the use of the Website Content.

The Website Administrator is not responsible for advertising messages posted on the Website or for goods or services provided by the authors of such advertising messages.

In cases of force majeure, the Website Administrator and/or its operators, directors, employees, branches, and representatives are fully exempt from liability. Force majeure cases include but are not limited to technical equipment failures, internet outages, telephone line failures, computer viruses, cyberattacks, unauthorized access, operational errors, strikes, etc.

Users agree to indemnify and hold harmless the Website Administrator and/or its operators, directors, employees, branches, and representatives from and against any claims, losses, damages, costs, expenses, judgments, fines, or obligations resulting from or related to the User’s improper use of the Website or Service.

Applicable Law. Disputes

The rights and obligations of the Users and the Website Administrator provided by these Terms and Conditions, as well as all legal effects arising from them, shall be interpreted and governed in accordance with Romanian law. Any dispute arising out of or in connection with these Terms and Conditions shall be settled amicably. If no agreement can be reached, the dispute shall be settled by the competent Romanian courts within the territorial jurisdiction of Bucharest.

Modification of the Terms and Conditions

The Website Administrator reserves the right to modify at any time and in any manner any provision of these Terms and Conditions or the Terms and Conditions as a whole, without prior notice and without being required to fulfill any other formalities toward Users. Any modification shall be deemed fully and unconditionally accepted by any User through the mere use or access of any facility offered by the Website or Service after such modification has been made. Failure to accept any modification obliges the respective User to immediately cease accessing the Website and/or using the Service in any way.
